El presidente Iván Duque sancionó la norma con la que millones de colombianos podrán borrar su historial negativo en centrales de riesgo.
El proyecto de ley de Habeas Data Financiero, también conocido como la ley de ‘borrón y cuenta nueva’ en centrales de riesgo, entró en vigencia este viernes 29 de octubre, luego de que el presidente Iván Duque sancionará la norma.
Se calcula que más de 10 millones de ciudadanos podrán recuperar su vida crediticia y borrar sus reportes negativos en las centrales de riesgo, lo que se convierte en un impulso importantísimo para la recuperación económica del país.
Pero, ¿qué beneficios trae?, ¿a quiénes aplicaría?, ¿cuáles son los objetivos de la iniciativa?
A continuación el recuento de los puntos más importantes de este proyecto.
ABECÉ DEL ‘BORRÓN Y CUENTA NUEVA’
– Amnistía por única vez para quienes se pongan al día en los 12 primeros meses de vigencia de la ley o ya lo hayan hecho con anterioridad. Saldrán de las Centrales de Riesgo en máximo seis meses. Estudiantes con créditos educativos del Icetex, pequeños productores, jóvenes rurales, mujeres rurales y víctimas del conflicto armado que extingan su deuda saldrán inmediatamente del reporte negativo.
– Las personas que tengan deudas inferiores al 15% del salario mínimo (menos de $136.279) recibirán dos comunicaciones antes de ser reportadas negativamente (con 20 días de diferencia entre una y otra comunicación).
– La calificación crediticia deberá normalizarse de inmediato cuando se elimine el reporte negativo.
– La consulta de información crediticia siempre será gratuita en todo tiempo y en todos los canales y no disminuirá la calificación.
– Se prohíbe la consulta a las Centrales de Riesgo para otorgar un empleo. (Excepto para empleados del sector financiero).
– Se protege a las víctimas de suplantación personal. Con la sola comunicación y acompañando como mínimo de la copia de la denuncia penal del fraude a la entidad financiera se eliminará el reporte negativo, dejando una leyenda que indique «víctima de falsedad personal».
– El tiempo del reporte negativo en las Centrales de Riesgo será del doble del tiempo de la mora y hasta máximo cuatro años. Sigue como está en la ley actual de Habeas Data.
– Se ordena a las centrales de riesgo crear una aplicación digital y gratuita de acceso público a todos los titulares de datos, donde se generen alertas al momento de adquirir nuevas obligaciones, esto para mitigar el riesgo de suplantaciones. (La información debe actualizarse máximo 5 días después de adquirida la obligación).
– En el mercado crediticio seguirá existiendo suficiente información que permita tomar decisiones a los establecimientos de crédito.
– El historial crediticio de las personas naturales y jurídicas se mantiene, tanto para las personas con buenos hábitos de pago como para las personas con malos hábitos de pago.
– Para otorgar un producto o un crédito las entidades del sistema financiero no podrán usar exclusivamente el historial crediticio. Deberán considerar otros factores o elementos de juicio que inciden en el estudio de riesgo. Además, se les exige indicar por escrito los motivos del rechazo de una solicitud.
– Serán eliminados los reportes negativos causados entre el inicio de la emergencia sanitaria causada por el Covid-19 y el 31 de diciembre de 2020, siempre que los titulares de la obligación hayan intentado una reestructuración de la obligación. (De continuar la mora posterior al 31 de diciembre de 2020, sí se reanudará el reporte).
Ninguna entidad podrá exigir al titular la presentación de documentos o trámites adicionales.
En resumen, si el titular se pone al día con las cuotas atrasadas de su crédito, la obligación ya está prescrita o se logra un acuerdo de pago con la entidad financiera, solo debe esperar a que se cumplan los plazos de la amnistía para que las Centrales de Riesgos eliminen el reporte.
Igualmente, para los deudores del Icetex, los pequeños productores, jóvenes rurales, mujeres rurales y víctimas del conflicto armado al extinguir su deuda saldrán inmediatamente del reporte negativo, sin tener que esperar plazo alguno.
