Gobierno Petro gana batalla por hacienda La América e iniciará la adjudicación colectiva a más de 100 familias campesinas del Cesar

El Gobierno nacional, a través de la Agencia Nacional de Tierras (ANT), iniciará la adjudicación colectiva de la hacienda La América a las asociaciones de más 100 familias campesinas de Chimichagua (Cesar), luego de haber cumplido con todos los trámites administrativos correspondientes al proceso de compra del predio, cuya extensión es de 1.400 hectáreas, y que ahora le pertenecen legalmente al Gobierno nacional después de una fuerte batalla legal.

Con el certificado expedido por la Superintendencia de Notariado Registro, que acredita a la entidad como propietaria del predio, se cierra la conjetura sobre el dominio de la emblemática hacienda, entregada por el presidente Gustavo Petro a las familias beneficiarias el 23 de noviembre de 2024.

“Hoy se desvirtúa lo manifestado por algunos actores de la región, que se han opuesto desde un principio a que el predio fuera entregado a los campesinos. A la fecha, reposa en el folio de matrícula inmobiliaria el registro del acto administrativo de transferencia del derecho de dominio a favor de la Agencia Nacional de Tierras», explicó la coordinadora del convenio entre la ANT y el Fondo de Víctimas, Natalia Astroz Gómez.

La hacienda La América le perteneció a José Guillermo Hernández Aponte, conocido como el ‘Ñeñe Hernández’, y luego fue comprada por Hugues Rodríguez Fuentes, alias ‘Comandante Barbie’.

Según la ANT, Rodríguez, a través de la empresa Inversiones Rodríguez Fuentes, mantuvo el control de la hacienda pese a que en el 2023 el Tribunal Superior del Distrito Judicial Sala y Justicia y Paz de Barranquilla se la había otorgado al Fondo de la Unidad para la Atención y Reparación Integral de las Víctimas.

El director de la Agencia Nacional de Tierras, Felipe Harman, dijo que con las 1.400 hectáreas de tierra del predio La América  en Chimichagua “completamos más de 13.400 hectáreas destinadas a la Reforma Agraria en el Cesar», y agradeció al Ministerio Público y a la Fuerza Público por el acompañamiento en el proceso.

Para Jhon Prieto, líder campesino y fundador de la Comisión por la Vida Digna, la Tierra y los Territorios, entidad que agrupa a los campesinos que recibieron La América, el hecho de que se haya materializado la recuperación del predio de manera conjunta entre las organizaciones campesinas y la ANT es un gran logro para la Reforma Agraria.
